1. PURPOSE
These Terms and Conditions (the « Agreement ») govern the contractual relationship between Marjorie Loup, located at 280 rue de Magnan 26160 Salettes, France, hereinafter referred to as the « Provider, » and any individual or entity purchasing translation services via the Boost Book website, hereinafter referred to as the « Client. »
The « Boost Book » service consists of immersive literary translation (English-to-French or French-to-English), including cultural and stylistic adaptation based on a proprietary methodology.
2. ORDERING PROCESS AND PAYMENT
The ordering process is as follows:
- The Client selects the translation package corresponding to their project.
- Payment is made in full via the secure Stripe platform.
- Upon payment validation, the Client is redirected to a mandatory Narrative Profiling Questionnaire.
- The project is considered « Active » only upon receipt of both the original text and the completed questionnaire.
3. PRICING
Prices are listed in Euros (€) on the sales page. The Provider reserves the right to modify prices at any time; however, the price displayed at the time of purchase shall be the only one applicable to the Client.
4. DELIVERY TIMELINES
The standard delivery time is 7 business days from the receipt of the profiling questionnaire and the complete manuscript, unless a specific agreement is made for exceptional volumes (projects exceeding 650 pages).
The Provider shall not be held responsible for delays caused by the Client’s late transmission of necessary information.
5. CANCELLATION AND REFUND POLICY
In accordance with legal provisions regarding digital content and personalized services:
- The Client expressly acknowledges that the Boost Book service begins immediately upon receipt of the manuscript and questionnaire.
- Due to the highly customized nature of translation work (made-to-order), no right of withdrawal or refund can be exercised once the translation work has commenced.
6. INTELLECTUAL PROPERTY
Upon full payment for the service, the Provider assigns to the Client all intellectual property rights to the translated version of the text (including rights of reproduction, representation, and adaptation).
The Client remains the sole owner of their original work and its translation. The Provider is strictly prohibited from using the text for personal or commercial purposes.
7. CONFIDENTIALITY
The Provider agrees to maintain the strictest confidentiality regarding manuscripts and personal information transmitted by the Client. No text will be shared with third parties without the prior written consent of the author.
8. LIABILITY AND WARRANTY
Boost Book is an artistic literary translation service. The Provider commits to delivering a high-quality translation faithful to the Client’s narrative intent.
However, as translation is a creative act, the Client accepts that nuances in interpretation may exist.
The Provider is not responsible for the commercial success of the work following its translation. The Provider’s liability is strictly limited to the total amount paid by the Client for the service.
9. REVISIONS
The Client has 7 days following delivery to request minor adjustments if the translation does not align with the directions provided in the initial questionnaire. Major revisions requested due to a change in the Client’s artistic direction after delivery will require a separate quote.
10. GOVERNING LAW AND JURISDICTION
This Agreement is governed by and construed in accordance with French Law. In the event of a dispute, and following an attempt to reach an amicable solution, exclusive jurisdiction is granted to the courts of Valence (26), France.
